If you received an Actual Cash Value payment from PEMCO for a claim concerning damage or destruction of personal property under a PEMCO Property Insurance policy issued on any Washington property and which Actual Cash Value payment included at least one alleged deduction of a percentage of the sales tax from the Replacement Cost for an item of damaged or destroyed personal property any time after June 1, 2014, please carefully read this notice. • Tina Mackay (referred to in this notice as “Plaintiff”), has sued PEMCO Mutual Insurance Company (referred to in this notice as “Defendant”) based on alleged violations of state law.

• The Court has allowed the lawsuit to proceed as a class action on behalf of all consumers who received an Actual Cash Value payment from PEMCO for a claim concerning damage or destruction of personal property under a PEMCO Property Insurance policy issued on any Washington property and which Actual Cash Value payment included at least one alleged deduction of a percentage of the sales tax from the Replacement Cost for an item of damaged or destroyed personal property any time after June 1, 2014.

• Defendant denies all of the allegations in the lawsuit.
